Is Mexican Auto Insurance Required by Law?

Yes. Mexican auto insurance is required by law on all of Mexicoโ€™s federal highways, toll roads, and bridges. Since January 2012, the state of Baja California has also required all drivers to carry third-party liability coverage issued by a Mexican insurance company.

Your US or Canadian auto insurance policy is not recognized in Mexico, even if it states coverage extends to border areas. Mexican law requires that financial responsibility be proven through a policy issued by a Mexican-licensed insurer. Without it, you have no legal protection if youโ€™re involved in an accident.

The Napoleonic Code: Why This Matters for Drivers

Mexicoโ€™s legal system operates under the Napoleonic Code, which differs fundamentally from the English Common Law system used in the United States and Canada. Under the Napoleonic Code, if you are involved in an automobile accident, you are considered at fault until you can prove otherwise.

In Mexico, a traffic accident that results in property damage or bodily injury is treated as both a criminal and a civil matter. This means that after an accident, you may be detained by authorities until financial responsibility is established. There are only two ways to resolve this on the spot: pay for all damages immediately in cash, or present a valid Mexican auto insurance policy as proof of financial responsibility.

For most travelers, carrying thousands of dollars in cash is not practicalโ€”which makes purchasing Baja Mexico auto insurance before you cross the border the only realistic option.

What Does Mexican Auto Insurance Cover?

Baja-Mex offers two levels of Baja Mexico insurance coverage for cars, trucks, SUVs, RVs, and motorcycles traveling in Mexico. All policies are underwritten by Grupo Nacional Provincial (GNP Seguros), Mexicoโ€™s largest and most established insurance company, operating since 1901.

Liability Only Coverage

Our liability policy provides the minimum coverage required by Mexican law. It includes:

  • Combined Single Limit (CSL) of $100,000 USD โ€” covers both property damage and bodily injury to third parties
  • Medical expenses of $5,000 per person, up to $25,000 per accident โ€” for you and your passengers
  • Legal assistance and defense costs โ€” including attorney fees, court costs, and bail bond at no additional charge
  • 24/7 bilingual claims hotline โ€” toll-free from anywhere in Mexico

Liability coverage is a good option for older vehicles where the primary concern is protecting yourself from third-party claims and legal costs.

Full Coverage (Maximum Protection)

Our full coverage policy includes everything in the liability plan, plus physical damage protection for your own vehicle:

  • All liability coverage listed above
  • Collision, overturning, and glass breakage โ€” $500 deductible
  • Fire, theft, vandalism, and natural disasters โ€” $1,000 deductible
  • Theft coverage extends to parts and accessories permanently attached to the vehicle
  • Legal assistance, defense costs, and bail bond included

Full coverage is recommended for newer vehicles and any trip where you want complete peace of mind. If your US or Canadian auto policy does not include comprehensive and collision coverage, you are not eligible for full coverage on your Mexican policy.

How Much Does Mexican Auto Insurance Cost?

The cost of your Baja Mexico car insurance depends on several factors, including the value of your vehicle, the level of coverage you choose, how long you need coverage, and where you plan to travel in Mexico.

Policies are available for as little as one day or up to a full year (365 days). Here are some general guidelines:

  • Day trips and weekend getaways: Daily policies are the most affordable option for short visits to Baja
  • Frequent travelers: Multi-day, monthly, or annual policies offer better per-day rates
  • Baja-only discount: If youโ€™re staying within the Baja California peninsula, you may qualify for up to 20% savings on your premium
  • Vehicle value: Lower-value vehicles cost less to insure. Youโ€™ll need your vehicleโ€™s Kelley Blue Book value when getting a quote

Important: Policies are sold in 24-hour increments starting from the time you enter Mexico. If you enter at 10:00 AM on Friday and return at 3:00 PM on Sunday, you need a three-day policy. If you return earlier than planned, you may be eligible for a refund on unused daysโ€”simply return the original policy to any Baja-Mex location.

Does Your US Auto Insurance Cover You in Mexico?

In most cases, no. While some US insurance companies extend limited coverage into Mexico, this coverage is typically restricted in important ways:

  • Coverage may only apply within 25 miles of the US border
  • Coverage is often limited to physical damage and theft of your vehicleโ€”not liability
  • Time limitations usually apply (often only a few days)
  • Your US insurer has no authority to adjust or settle a claim inside Mexico
  • If you are a frequent traveler to Mexico, your US carrier may remove this coverage from your policy entirely

Most critically, US insurance does not include legal assistance in Mexico. Under Mexicoโ€™s legal system, this is the most important component of your coverage, itโ€™s what keeps you out of jail after an accident.

We strongly recommend purchasing a separate Mexican auto insurance policy for every trip, regardless of what your US policy states. The cost is minimal compared to the risk.

What Happens If Youโ€™re in an Accident in Mexico?

If youโ€™re involved in an accident while driving in Mexico, follow these steps:

  1. Stay at the scene. Do not leave the accident site. Under Mexican law, leaving the scene of an accident can result in additional criminal charges.
  2. Call the 24/7 claims hotline. Every Baja-Mex policy includes a toll-free number you can call from anywhere in Mexico. Bilingual representatives are available around the clock to guide you through the process.
  3. Your insurance adjuster will respond. GNP Seguros will dispatch an adjuster to the scene of the accident. The adjuster will document the damage, communicate with the other partyโ€™s insurer, and handle negotiations.
  4. Legal representation is included. If authorities arrive and a legal proceeding begins, your policy includes legal defense, attorney fees, court costs, and bail bond at no additional cost to you.
  5. Report your claim before returning to the US. This is critical. You must report your claim to the insurance company while you are still in Mexico. Returning to the United States without first reporting your claim may result in denial of coverage.

Important: Your policy is void if the vehicle was being driven by someone without a valid driverโ€™s license, if the driver was under the influence of alcohol or drugs, or if the vehicle was driven off maintained roads (such as beaches, sand dunes, or dirt trails). If you are towing a vehicle or trailer, both must be declared on the policy with the appropriate premium.
